Evertrust being sued for "deficiencies and failures" at Niagara Falls condo
The developer behind the collapsed condo project in Welland is being sued by residents in a Niagara Falls condo.
According to the CBC, the residents of Upper Vista Niagara Falls have filed a $10 million lawsuit for "deficiencies and failures" including malfunctioning heating and air conditioning and building code violations.
The suit names the developer, Evertrust, as well as the City of Niagara Falls and five other groups involved in contracting, architecture and engineering.
Patricia Elia, the lawyer representing the residents, tells the CBC the claims have not been tested in court, and no statement of defense has been filed.
The statement of claim also says the building has experienced flooding and sanitary backups due to botched installations.
Evertrust is also the developer behind Upper Vista Welland on Prince Charles Drive, which suffered two partial collapses within the span of eight days.
The developer has applied to the City of Welland for a partial demolition permit, however, it still says the Welland site will be built.
The demolition work could start as early as Monday.
