SIU Says No Charges in Injuries Suffered by Woman in Police Custody

SIU says officer did not use excessive force

The province's Special Investigations Unit has cleared a Niagara Regional Police officer after a 25 year old woman sustained a serious injury while in police custody.

The incident happened on May 8th.

The SIU says during a struggle while in custody the woman kicked a witness officer and the subject officer responded by striking the woman twice with an open hand in the head.

The police watchdog says this was followed by a third strike when the woman lashed out again kicking.

SIU Director Joseph Martino says he is satisfied the force used by the officer did not exceed the range of what was reasonably necessary in the circumstances to maintain safe custody over the woman.
